Q. What is a Notary Public?

A. The court defines a Notary Public as a “Public Ministerial Officer;” an agent for the state.  A Notary is a public officer commissioned by the office of the Secretary of the State to witness signatures on legal documents and to verify that the name shown by the signature is the actual name of the person signing the document. A Notary Public is a public official who not only has the power to acknowledge signatures but to administer oaths or affirmations as well.

Q. Why are documents notarized?

A. A notary is used to deter fraud.  A Notary is an impartial witness that ensures that the signer of the document is who they say they are.  The Notary makes sure the signer is entering into the agreement knowingly and willing.

Q. How do I know if a document needs to be notarized?

A. A document needs to be notarized if it contains:

1.       Text committing the signer in some way;

2.       An original signature is needed (not a photocopy);

3.  The document contains a notarial “certificate” (i.e. acknowledgement) which may appear on

the document or the document may ask for a notarized attachment to be added.

Q. How does a Notary identify a signer?

A. The Notary will need to see a current form of identification that is issued by a governmental agency that has a photograph, physical description and a signature.  A valid Driver’s License, State ID Card, Passport, or military ID are the most common forms used for identification.

Q. What are the most common forms of ID?

A. Each signer must have a valid photo ID such as:

•  Current  California Drivers License or ID Card (issued within the last five years)

•  US Military Identification card (Issued within the last five years)

•  Current Passport. (Non- US Passports must have been stamped by the INS)

Q. What if I don’t have a current form of ID?

A:  You must have two other persons present who will swear to the signer’s identity that have a valid form of ID.  Speak with your Notary if you do not have a current form of ID to find out the best option for you.

Q. Does a notarization mean that a document is “true” or “legal”?

A. No.  Notaries are impartial to the documents that they notarize which means they cannot give legal advice to the accuracy or legality of any document.  Notaries only certify the identity of the signers and make sure the signers are entering into the agreement knowingly and willingly.

Q. Can I use a notary instead of Loan Signing Agent?

A. Yes.  A Loan Signing Agent IS a Notary.  Our Notaries are licensed and bonded who specialize in loan documents.  We know it is hard to have you or your clients take time off of work to coordinate with a bank or title company; that’s why our Loan Signing Agents (notaries) are mobile.  You pick the time and the place and we will come to you.
